Use of Balaji Infotech’s Service constitutes acceptance and agreement to Balaji Infotech’s Terms of Service.
All provisions of this contract are subject to the Terms of Service of Balaji Infotech. The terms of service may be changed from time to time at the discretion of the Company. Subscriber understands that change to the terms of service by the Company shall not be grounds for early contract termination or non-payment.
The terms of service specifically prohibit the use of our service for illegal activities. Therefore, the Subscriber agrees that the Company may disclose any and all subscriber information including assigned IP numbers, account history, account use, etc. to any law enforcement agent who makes a written request without further consent or notification to the Subscriber. In addition, Balaji Infotech shall have the right to terminate all services set forth in this Agreement.
We will not be liable or become involved in any disputes between the site owner and their clients and cannot be held responsible for any wrongdoing on the part of a site owner. eg. Any disputes regarding content/images that have been provided to us for inclusion on the site.
Whilst every endeavor will be made to ensure that the website and any scripts or programs are free of errors, Sims Designs cannot accept responsibility for any losses incurred due to malfunction, the website, or any part of it.
The client agrees to make available as soon as is reasonably possible to Sims Designs all materials required completing the site to the agreed standard and within the set deadline.
Balaji Infotech reserves the right to suspend network access to any customer if in the judgment of the Balaji Infotech network administrators the customer’s server is the source or target of the violation of any of the other terms of service or for any other reason which Balaji Infotech chooses. If inappropriate activity is detected, all accounts of the Customer in question will be deactivated until an investigation is complete. Prior notification to the Customer is not assured. In extreme cases, law enforcement will be contacted regarding the activity. The customer will not be credited for the time the customer’s machines were suspended.
Balaji Infotech wishes to emphasize that in agreeing to the Terms of Service (ToS), the customer indemnifies Balaji Infotech for any violation of Terms of Service (ToS) that results in loss to Balaji Infotech or the bringing of any claim against us by any third-party. This means that if Balaji Infotech is sued because of a customer’s or a customer of a customer’s activity, the customer will pay any damages awarded against Balaji Infotech, plus all costs and attorney’s fees.
You must provide us with, and keep current, good contact information for you. E-mail, fax, and telephone contacts are used, in that order of preference.
The customer agrees not to remove, modify or obscure any copyright, trademark, or other proprietary rights notices that appear on Software Products or that appear during the use of Software Products. The customer further agrees not to reverse engineer, decompile, or disassemble the Software Products.
Checks and Drafts returned for any reason are subject to returned item charges. Service will be interrupted on accounts that reach 7 days past due. Service interrupted for nonpayment may be subject to a reconnect charge fixed at the sole discretion of Balaji Infotech. Accounts not paid by the due date may be subject to a late fee at the sole discretion of Balaji Infotech. If you desire to cancel your account, please email balajietech.com 30 days before the expiry of the account. Failure to notify cancellation would result in services billed and payable for the next period.
A non-refundable deposit of 50% is required with all of our projects before any design work will be carried out. When you buy our products/services, Due to the nature of business, Balaji infotech does not offer any money-back policy. If you are, for any reason, not entirely happy with your purchase, you must bring it to the notice of our customer support within 24 hours of receiving the product. The Customer Support Team after looking into your complaint will take an appropriate decision.
All sub-networks, resellers, customers, and managed servers of Balaji Infotech must refer to the above policies before making the payment. Failure to follow any term or condition will be grounds for immediate Cancellation of the account and money will not be refunded back.
The Company may temporarily deny and suspend all accounts and services provided to a customer or terminate this Agreement upon the failure of the customer to pay charges when due. Such termination or denial will not relieve the Subscriber of responsibility for the payment of all accrued charges, plus reasonable interest and any collection fees.
